DMCA Notice of Copyright Infringement

DIGITAL MILLENNIUM COPYRIGHT ACT NOTICE AND POLICY

Gooners respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, Gooners will respond expeditiously to claims of copyright infringement committed using the Gooners website (the "Website") that are reported to Gooners's Designated Copyright Agent, identified below.

NOTICE OF CLAIMED INFRINGEMENT

If you are a copyright owner, or are authorized to act on behalf of a copyright owner, or are authorized to act under any exclusive right under copyright, and you believe that your copyrighted work has been copied, uploaded, or otherwise made available on the Website in a way that constitutes copyright infringement, please report your notice of infringement to Gooners's Designated Copyright Agent by providing ALL of the following information in writing:

  1. Identification of the copyrighted work: Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. Please provide sufficient detail to identify each work (e.g., title, registration number if available, URL of original work, etc.);
  2. Identification of the infringing material: Identification of the material that you claim is infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Gooners to locate the material. Please provide the specific URL(s) of the page(s) containing the allegedly infringing material. General information about the location of the material is not sufficient;
  3. Your contact information: Information reasonably sufficient to permit Gooners to contact you, including your full legal name, mailing address, telephone number, and email address;
  4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  5. Accuracy and authorization statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and
  6. Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

IMPORTANT: Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, by any copyright owner or copyright owner's authorized licensee, or by Gooners. Gooners reserves the right to seek damages from any party that submits a notification of claimed infringement in violation of the law.

COUNTER-NOTIFICATION PROCEDURES

If you believe that material you posted on the Website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with Gooners's Designated Copyright Agent (a "Counter-Notice"). Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  1. Your signature: Your physical or electronic signature;
  2. Identification of removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled (please provide the specific URL(s));
  3. Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled;
  4. Your contact information: Your full legal name, mailing address, telephone number, and email address; and
  5. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are located outside the United States, that you consent to the jurisdiction of any judicial district in which Gooners may be found), and that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person.

If a valid Counter-Notice is received by Gooners's Designated Copyright Agent, Gooners will send a copy of the Counter-Notice to the original complaining party. The original complaining party will then have ten (10) business days to notify Gooners that they have filed a legal action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on the Website. If Gooners does not receive notice of such legal action within the ten (10) business day period, Gooners may, in its sole discretion, restore the removed material or cease disabling access to it.

REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable law, Gooners has adopted a policy of terminating, in appropriate circumstances and at Gooners's sole discretion, users who are deemed to be repeat infringers. Gooners may also, at its sole discretion, limit access to the Website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Gooners considers a "repeat infringer" to be any user that has been the subject of more than two (2) valid DMCA takedown notices. However, Gooners reserves the right to terminate any user's account after a single instance of infringement if, in Gooners's sole judgment, such termination is warranted.

ACCOMMODATION OF STANDARD TECHNICAL MEASURES

Gooners accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works that are developed pursuant to a broad consensus of copyright owners and service providers in an open, fair, voluntary, multi-industry standards process, are available to any person on reasonable and nondiscriminatory terms, and do not impose substantial costs on service providers or substantial burdens on their systems or networks.

MODIFICATIONS TO THIS POLICY

Gooners reserves the right to modify, amend, or update this DMCA Policy at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website following the posting of any changes constitutes your acceptance of such changes.
